Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to your use of Gordon CRM and any associated services, software, APIs, or websites (collectively, the "Service"). This AUP is designed to protect Gordon CRM, our customers, and the general public from illegal, abusive, or irresponsible behavior.
This AUP is incorporated by reference into the Gordon CRM Terms of Service. By accessing or using the Service, you agree to comply with this AUP. We reserve the right to modify this AUP at any time by posting a revised version on our website. Your continued use of the Service constitutes acceptance of those changes.
1. Reporting Suspected Violations
We encourage anyone who suspects a violation of this AUP to report it to us immediately by emailing [email protected]. We will investigate all reports and take appropriate action.
2. General Prohibitions and System Integrity
You agree not to use, or encourage or permit others to use, the Service to:
- Disrupt the Service: Overburden, impair, or disable any Gordon CRM servers, networks, or underlying infrastructure. This includes launching automated systems like "robots," "spiders," or "scrapers" that send more requests to our servers than a human could reasonably produce.
- Gain Unauthorized Access: Attempt to bypass security measures, access accounts other than your own, or share login credentials among multiple users.
- Distribute Malware: Upload or distribute viruses, corrupted files, trojan horses, or any other malicious code designed to damage or exploit software or hardware.
- Infringe Intellectual Property: Publish, upload, or distribute any material protected by copyright, trademark, or trade secret laws without necessary rights and consents.
3. Email, Messaging, and Anti-Spam Requirements
To protect the deliverability and reputation of all Gordon CRM users, you must strictly adhere to the following when using our communication tools:
- No Spam: You may not use the Service to send unsolicited commercial email or text messages.
- Verifiable Opt-In: You must be able to verify that every contact in your database has provided express, verifiable consent to receive communications from you.
- No Purchased Lists: You may not send messages to email addresses, phone numbers, or contacts acquired through purchased, rented, or third-party lists.
- Accuracy: You may not use misleading or false headers, sender names, addresses, or subject lines.
- Regulatory Compliance: You must comply with all applicable local, state, and international communication laws, including but not limited to the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and Canada's Anti-Spam Legislation (CASL).
4. Prohibited Content & Discriminatory Practices
You may not use the Service (including custom data fields, form submissions, and messaging) to create, store, or distribute content that:
- Is threatening, abusive, harassing, defamatory, or invasive of another's privacy.
- Is deceptive, false, fraudulent, or misleading.
- Contains obscene, excessively violent, or sexually explicit material.
- Promotes, facilitates, or encourages illegal activity.
- Violates Anti-Discrimination Laws: You may not use the Service's data collection (such as custom fields), filtering, or reporting capabilities to discriminate based on race, color, religion, sex, sexual orientation, gender identity, disability, familial status, or national origin in violation of laws such as the Fair Housing Act or Equal Credit Opportunity Act.
5. Sensitive Data & User Responsibilities
As the Workspace Owner, you are the Data Controller of the information you put into Gordon CRM. You are solely responsible for ensuring you have the legal right to collect and process this data. You explicitly agree not to use the Service to collect, store, or transmit:
- Payment Card Information (PCI): Full credit/debit card numbers or CVV codes.
- Protected Health Information (PHI): Any medical data subject to HIPAA or similar healthcare privacy laws.
- Highly Sensitive Identifiers: Social Security Numbers, driver's license numbers, passport numbers, or financial account routing numbers.
6. Restricted Industries
Due to higher-than-average abuse and spam complaints that can negatively impact the Service for all users, we reserve the right to suspend or terminate your use of Gordon CRM if you operate in or promote any of the following industries:
- Cryptocurrencies, initial coin offerings (ICOs), or non-fungible tokens (NFTs).
- Multi-level marketing (MLM), pyramid schemes, or "get rich quick" affiliate programs.
- Online or offline gambling, sports betting, or lottery services.
- Escort services, mail-order brides, or illicit dating services.
- Payday loans, predatory lending, or debt collection services.
- Pharmaceutical products, diet pills, or unregulated supplements.
- The sale of followers, "likes," or engagement for social media platforms.
7. Enforcement and Remediation
Gordon CRM retains the right, in our sole discretion, to monitor use of the Service to ensure compliance with this AUP. If we determine that you have violated any provision of this policy, we may take immediate action without prior notice or liability, including:
- Suspending or terminating your access to the Service.
- Deleting or modifying data, custom fields, or content that violates this AUP.
- Reporting the violation to law enforcement or regulatory authorities.
In the event of an account suspension or termination due to an AUP violation, you will not be eligible for a refund of any prepaid fees.
